I was shown, very quickly, a Sauer 38h with rough polish and thinning finish. The finish is not brown just more like a watercolor facsimile of a real bluing...typical of later war pieces. Sorry I was not able to get the serial number but I suspect it is a type 4 or 4a. The hammer drop was present but I do not recall the pistol having a safety. The left grip does have a hairline failure and the magazine may be a replacement. There is an eagle/F on the left trigger guard. The price is $350 and the seller will not take my C&R. Thus I will have to pay the look up fee and tax bringing the price up near $400. Is it worth this? Is this a decent price or too high. They are using the blue book to price this pistol but really do not know about the Police marking (they have it marked WaA marked). I would say the remaining finish is 95%+ but very thin. Oh and the pistol comes with a brown holster that is WWI marked but has had the flap re-cut to fit the 38h. What say y'all?

MIchael, I do not know.

But I think I would print out info on the 03 FFL, and tell them, look, I am a licensed collector, same as an FFL 01, entitled by gov't regulation to buy guns that are listed. And show him the listing, or cut and paste if it is on-line. I have found in my limited on-line buying that if you say C&R license they act like no way! But if you say, FFL 03 Collectors license, they accept it.

Michael, If it's in decent shape. Grab it! That's a good price. For even a WAa marked 38H.Let alone a police.
I'm in complete agreement with Ed about the C&R. Question them as to why they won't accept it? They are actually in violation of ATF regs. by not accepting it. It's your legal right.
Good Luck! Ron

PS Even if you have to pay the extra to a dealer, it's still agood deal.

Michael, It sounds like a 4-a Police Accepted. I'd go for it. A lot of so called dealers don't know what a C&R is, or what it is for, heck, some of their tables dont want to sell to a Class 1 without doing paperwork. I suspect they have "know nothings" working their tables for them, or are pocketing the fees. Ask to talk to the owner. If it's over 50 years old, or WWII produced, it's a C&R and the must sell it to you if you have a Class 3 Collectors License. As the holder of a Class 3 C&R, you are technically a licensed dealer, according to the BATFE. Even if they won't take your license, the gun is probably worth the extra.

Well, I have dealt with these people before and they are decent folks. The local (in THAT area) BATFE has a hair-up-the butt about C&Rs and has scared the hell out of the 01FFLs. I have bought from them in the past. Sometimes they take my FFL; sometimes they refuse. I think it has to do with how long back was their last visit from the compliance folks. I was told this time they would not take my C&R unless this pistol was specifically listed on the C&R list. I will have to check the list to see if Sauer 38h's are listed. No sense talking logic to folks who are scared....although I will try again to.

My postulate was how much of a bargain would this piece be if it were in the $400 range by the time I walked out the door? Would y'all pick it up quickly or is it mearly a decent deal? I am thinking about going back to take it but wanted to know if I should RUSH or take my time!

Michael, I would go get it! I almost waited too long on a commercial. And just lost a WaA marked one today. They usually run in the $450.00 to $500.00 range, in average cond. If you don't want it, please let me know where it is, and I will buy it.

Regards, Ron
